1. Eligibility

You must be at least 18 years old (or 16 in jurisdictions where that is the minimum age of digital consent) to create an account and use the App. By using the App, you represent and warrant that you meet this requirement.

The App is not intended for use by children under 13. If we become aware that a user is under 13, we will terminate their account and delete their data immediately.

2. Account Registration

To access most features, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at info@spacefolding.ai if you suspect unauthorised access

You may not create accounts on behalf of another person without their explicit consent, or use false identity information when registering.

3. Description of the Service

Nibblio is a nutrition and wellness application that provides:

• Nutrition tracking via camera scanning of food, barcodes, and nutrition labels
• Biomarker analysis from lab reports you upload or scan
• Integration with wearable devices and health platforms (Apple Health, Google Fit/Health Connect, Garmin, Fitbit, Whoop, and others) to incorporate biometric data
• Personalised nutrition guidance based on your dietary data and biomarkers

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. Health & Medical Disclaimer

The nutritional guidance, biomarker insights, and wellness suggestions provided by the App are for general informational and educational purposes only. They are based on the data you provide and publicly available nutritional information, and are not tailored to your individual medical history or clinical needs.

Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or health management — especially if you have an existing medical condition, are pregnant or breastfeeding, or are taking prescription medication.

Space Folding expressly disclaims all liability for any health outcomes, adverse effects, or decisions made in reliance on information provided by the App. Your use of the App is entirely at your own risk in this regard.

5. Subscriptions & In-App Purchases

Nibblio offers the following access tiers:

Prices are displayed in the App before purchase and are inclusive of applicable taxes where required by law. All purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms of service in addition to these Terms.

6. Billing, Renewals & Cancellation

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the renewal date. Your payment method on file with Apple or Google will be charged at renewal.

Price Changes

We may change subscription pricing at any time. We will notify you at least 30 days in advance of any price increase. Continued use of the subscription after a price change constitutes acceptance of the new price.

Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings:

• iOS: Settings → Apple ID → Subscriptions → Nibblio → Cancel
• Android: Google Play → Subscriptions → Nibblio → Cancel

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date. We do not process cancellations via email.

Free Trials

Where a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless cancelled beforehand. Only one free trial is available per user per subscription tier.

7. Refunds

All purchases are processed by Apple or Google. Refund requests are governed by their respective refund policies:

• Apple: reportaproblem.apple.com
• Google: Google Play refund policy

Space Folding does not independently issue refunds for purchases made through the App Store or Google Play. If you believe you are entitled to a refund for reasons outside those platforms' policies, contact us at info@spacefolding.ai and we will review your case.

8. User Content

“User Content” means any data, images, documents, or information you submit to the App, including food photos, lab reports, and health data entries.

Your Ownership

You retain ownership of your User Content. You grant Space Folding a limited, non-exclusive, worldwide licence to store, process, and use your User Content solely to provide and improve the App's features for you.

Our Use of Your Data

We may use anonymised, aggregated data derived from User Content to improve our AI models and nutritional databases. This anonymised data cannot be linked back to you. We will never use your identifiable health or biometric data for purposes outside what is described in our Privacy Policy.

Your Responsibility

You are responsible for the accuracy of the data you submit. The quality of the App's recommendations depends directly on the accuracy of your inputs. Do not submit data belonging to another person without their explicit consent.

9. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulation
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Access or attempt to access another user's account or data
• Submit false, misleading, or fraudulent health data
• Use automated tools (bots, scrapers) to interact with the App
• Interfere with or disrupt the App's infrastructure or servers
• Resell, sublicence, or commercially exploit any part of the Service without our written permission
• Upload content that infringes third-party intellectual property rights
• Attempt to circumvent subscription restrictions or access paid features without payment

Violation of these rules may result in immediate account suspension or termination.

10. Third-Party Integrations

The App integrates with third-party health platforms and wearable services including Apple Health (HealthKit), Google Fit, Health Connect, Garmin, Fitbit, Whoop, and others. These integrations are subject to the terms and privacy policies of the respective third parties.

Space Folding is not responsible for:

• The accuracy, availability, or reliability of data provided by third-party platforms
• Any changes to third-party APIs that affect App functionality
• Any actions taken by third-party services with respect to your data on their platforms

We are not affiliated with, endorsed by, or officially connected to Apple, Google, Garmin, Fitbit, or Whoop. Use of their names is purely for descriptive purposes.

11. Intellectual Property

All content in the App — including but not limited to software, AI models, algorithms, nutritional databases, UI design, logos, and text — is the exclusive intellectual property of Space Folding or its licensors, and is protected by applicable copyright, trademark, and other intellectual property laws.

These Terms do not grant you any rights to our intellectual property beyond the limited licence to use the App for its intended personal, non-commercial purpose.

“Nibblio” and the Nibblio logo are trademarks of Space Folding. You may not use our trademarks without prior written consent.

12. Disclaimers

The App and all content within it are provided “as is” and “as available”, without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or free of viruses
• Warranties as to the accuracy, completeness, or reliability of nutritional data or biomarker insights

Nutritional data is sourced from publicly available databases and AI analysis and may not be perfectly accurate. Biomarker interpretation is for general informational purposes only and may not reflect your actual clinical status.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Space Folding and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or health information
• Personal injury or health outcomes arising from reliance on the App
• Loss of profits or business opportunities
• Interruption or unavailability of the Service

Our total aggregate liability to you for any claims arising out of or related to these Terms or the App shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless Space Folding and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App in violation of these Terms
• Your User Content
• Your violation of any applicable law or third-party rights

15. Termination

By You

You may delete your account at any time from within the App's Settings. Upon deletion, your personal and health data will be permanently deleted within 30 days, as described in our Privacy Policy. Active subscriptions must be cancelled separately via your App Store or Google Play account before account deletion to avoid further charges.

By Us

We reserve the right to suspend or terminate your account, with or without notice, if you:

• Violate these Terms
• Engage in fraudulent, abusive, or illegal activity
• Cause harm to other users or our infrastructure

Upon termination by us for cause, no refund will be issued for any unused subscription period. If we terminate your account for reasons other than cause, we will issue a pro-rated refund for any unused paid subscription period.

Effect of Termination

Sections 4 (Health Disclaimer), 11 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), and 14 (Indemnification) survive termination of these Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of [JURISDICTION], without regard to its conflict of law provisions.

EU/EEA Users

If you are a consumer in the EU or EEA, you benefit from the mandatory consumer protection provisions of your country of residence. Nothing in these Terms limits those rights. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Dispute Resolution

We encourage you to contact us first at info@spacefolding.ai to resolve any dispute informally. Most issues can be resolved quickly this way. If informal resolution fails, disputes shall be resolved through binding arbitration or the courts of the governing jurisdiction, as applicable.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will provide at least 14 days advance notice via in-app notification or email before the changes take effect.

Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to material changes, you may delete your account before they take effect.
